BELLE MISS E-SHOP GENERAL TERMS AND CONDITIONS OF SALE

 

I – PREAMBLE AND PURPOSE

These General Terms and Conditions of Sale (hereinafter "GTC") define the terms and conditions for the online sale of Belle Miss products concluded via the merchant site accessible from the website www.bellemissparis.com. These conditions exclusively concern non-commercial individuals. You declare that you have read and accepted the GTC as well as the rights and obligations arising therefrom before placing your order. Validation of your order therefore constitutes acceptance of the current GTC.

These GTC prevail over any other document.

No tolerance shall be interpreted as a waiver of the rights and obligations resulting from these GTC. They may be modified at any time without prior notice.

This website is published and managed by SARL Belle Miss, with a capital of €40,000, whose registered office is located at 135 rue du Temple – 75003 PARIS, registered with the Paris Trade and Companies Register under number 345 242 184. It is subject to VAT and identified by an individual number in application of article 286 ter of the general tax code. Its individual identification number is FR43 345 242 184.

II – INFORMATION AND ACCESSIBILITY ON THE SITE

The site is accessible to all users with an internet connection, in principle 24/7, except for interruptions by Belle Miss or its service providers, whether for maintenance, security, or in cases of force majeure. Belle Miss cannot be held responsible for any damage, whatever its nature, resulting from the unavailability of the Site.

Belle Miss does not guarantee that the Site will be free of errors, breakdowns, or bugs. It may freely and at its sole discretion set any period of unavailability of the Site and its content.

Belle Miss reserves the right to evolve the Site for technical or commercial reasons. When these changes do not negatively alter the conditions for providing services, the Customer may be informed of the changes, however, their acceptance is not required.

Browsing and placing orders on the Internet imply knowledge and acceptance of the characteristics and risks associated with the Internet, in terms of technical performance, response time, risks of interruption, viruses, and more generally all risks associated with connecting and transmitting data over the Internet. Belle Miss cannot be held responsible towards the user or a third party for any damage of any kind caused by a computer virus or any other harmful component contained in a document, file, email, server, or any other computer medium originating from Belle Miss's computer system.

 

III – REGISTRATION ON THE SITE

To place an order, the Customer must register on the Site by creating an account containing the Customer's information.

The Customer's registration on the Site is done via a form. When creating the account, the Customer must ensure that their data is accurate. In case of error in the recipient's contact details, Belle Miss cannot be held responsible for the inability to deliver Products. The Customer is responsible for updating their personal information to avoid any delivery problems.

The registered Customer will receive, as part of the registration process, an email confirming their registration and then the registration of their potential order, sent to the email address they provided.

The Customer declares and guarantees to Belle Miss that they are of legal age and have the legal capacity to enter into a contract.

The Customer's username and password are confidential data. The Customer is solely responsible for any use that may be made of them, and solely guarantees their confidentiality, as well as any use of their account.

The Customer undertakes to register with only one username and password.

The Customer undertakes to inform Belle Miss immediately of any unauthorized use of their account, and of any breach of confidentiality and security of their identification means, by email to the address: bellemiss135@gmail.com

If Belle Miss has reasons to believe that the security of the Site is violated or that the identification means are misused, it may require their change.

Belle Miss cannot in any case be held responsible for any loss or damage resulting from a failure to comply with the obligations set out in this article. Insofar as their identification means have come into the hands of third parties through their fault, the Customer will be solely responsible for any use of these identification means and the use of the service made on this basis.

In the event that the Customer provides false, inaccurate, outdated or incomplete registration data, and/or there is reason to believe that they do not comply with these contractual conditions or that they are involved in fraudulent activities or other activities contrary to law, or in the event of other major causes, Belle Miss will be entitled to suspend or terminate their account without prior notice and to immediately and for the future refuse them access to all or part of the Service.

In accordance with the provisions of Law n° 78-17 of January 6, 1978, relating to data processing, files and freedoms, the site has been declared to the CNIL (Commission Nationale Informatique et Libertés) under number 2106403 v 0.

Personal information is never shared with third parties or resold.

Banking information is never held by Belle Miss. Transactions are entirely processed by our partner Stripe's secure payment module.

The Site uses cookies; the user is informed of the use of these cookies upon arrival on the website via a banner. Cookies allow information related to browsing the website to be recorded. These cookies are only installed after the user's acceptance, continued browsing on the website constituting acceptance. The user can choose not to use these cookies by configuring their browser. Cookies facilitate navigation on the site by, for example, recording products that the Customer has viewed or login credentials. There are three types of cookies: security cookies, functionality cookies, and others.

 

IV- PRODUCTS

All items for sale on the www.bellemissparis.com website are referred to as "Products".

Even if Belle Miss takes the utmost care in presenting the products and their description, the information and in particular the photos appearing on the website are provided without condition or guarantee that they are accurate, complete and up-to-date and do not form part of the contractual scope. You must review the description of each product to know its characteristics.

Products are available for sale while stocks last.

 

V - PRICE

Product prices are indicated in euros, including VAT, and all orders are payable in euros.

Prices take into account the VAT applicable on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the price of products in the online store. If one or more taxes or contributions, particularly environmental ones, are created or modified, whether upwards or downwards, this change may be reflected in the selling price of the products.

The prices indicated do not include processing fees (postage, packaging and package preparation according to the current amount).

Payment of the total price must be made at the time of the order. At no time can the sums paid be considered as deposits or down payments.

Belle Miss may modify its prices at any time, but products will be invoiced according to the rates applicable at the time the order is registered, provided the Product is available on that date.

Belle Miss retains ownership of the products until full payment of the order by the Customer.

For deliveries outside mainland France, customs fees and other taxes are not included in the price paid by the Customer. These fees must be paid by the Customer directly to the carrier.

 

VI - ORDERS

The Customer can freely browse the different pages of the site, without being committed to an order. The Customer places their order with payment obligation on the Website. Any order placement constitutes your acceptance of the prices and descriptions of the products you have placed in the basket.

The Customer can select as many Products as they wish, which will be added to the basket. The Basket summarizes the Products chosen by the Customer as well as their prices and associated fees. The Customer can freely modify the Basket before validating their Order. Validation of the Order confirms the Customer's acceptance of the GTC, the Products purchased, their price, and associated fees.

A confirmation email summarizing the Order (Product(s), price, quantity, delivery costs, discount) will be sent to the Customer. In this case, the Customer formally accepts the use of email for the confirmation of the content of their Order. The link to download the order invoice will be included in this confirmation email.

 

VII - PAYMENT

Payment is made according to the terms chosen by the Customer from those offered by Belle Miss. Online payment can be made by credit card (CB, Visa, Mastercard, Amex) or by Paypal, and by a Belle Miss purchase voucher to be used as a promotional code. The order validated by the Customer will only be considered effective when Belle Miss has received the full invoiced amounts from the relevant bank payment centers. In case of payment problems, the order will be automatically canceled and the Customer will be informed by email.

Credit cards are processed immediately and are the recommended payment method for quick delivery. Once your payment is approved, we begin processing your order.

The Customer must provide their credit card number, its type, its expiration date, and the cryptogram number (3-digit number on the back of the credit card). The Customer will make their payment via the Belle Miss website using Stripe. At no time will the Customer's banking data transit through Belle Miss's computer system. Belle Miss's liability is therefore discharged in this respect.

When purchasing on the Belle Miss Paris website, the entire transaction takes place on our banking partner's website in encrypted mode. You temporarily leave the Belle Miss Paris website, transparently, to record your banking details.

The credit card number is entered on a secure page, so it is not known by Belle Miss.

Information is encrypted (SSL technology).

 

VIII - DELIVERY

Deliveries are handled by La Poste's Colissimo services or by Mondial Relay, depending on the chosen option.

The delivery costs applicable to the Order are those mentioned on the site at the time of payment.

Delivery is made to the address indicated by the Customer, it being specified that this must be the address of the Customer's residence, of a natural person of their choice, or of a legal entity (delivery to their company).

Orders are processed from Monday to Friday. All orders placed before 1 PM will be shipped the same day. Orders placed between Friday 1 PM and Monday 1 PM will be processed and shipped on Monday.

Once the order has been shipped, an email specifying the order tracking number will be sent to the buyer.
The indicated deadlines are to be taken into account from the day the package was shipped from our premises and only in mainland France.

Any delays do not entitle the Customer to claim damages, cancellation of the order, or a reduction in the price paid. In the event of an unusual delay brought to the attention of Belle Miss, an email will be sent to you by customer service.

Belle Miss cannot be held responsible for the non-execution of the contract in cases of force majeure, disruptions or general, total or partial strikes, particularly of postal services and means of transport, floods, storms or fires.

 

IX - REFUNDS AND RETURNS

The customer has a period of 14 clear days to exercise their right of withdrawal without having to justify a reason or pay penalties (with the exception of personalized or "made-to-measure" items). Belle Miss extends this period to 30 clear days. This right is exercised by returning the product, only the shipping costs remaining at the customer's expense unless the error comes from Belle Miss.

All piercing and earring products are excluded from this right of withdrawal, for reasons of hygiene and health protection.

This period runs from the day of receipt of the order.

Returned products must be sent back in their original and complete condition (product label, accessories, cover, etc.) with a shipping method including a tracking number (proof of return), with a copy of the invoice.

Products must be intact, in perfect resalable condition, in a perfectly clean state; they must not have been worn or used, nor have suffered any damage. Any damage noted on a product upon return due to an unrespected packaging level issue may result in a partial refund or no refund of the product if it cannot be resold as is.

If the above conditions are met, the Buyer will be reimbursed, with the exception of return costs which remain the responsibility of the Buyer, within a maximum period of thirty (30) days from receipt of the package by the seller.

X - AVAILABILITY

The majority of products for sale are stored in our storage facility. Our products are offered subject to availability.
In the event of a stockout on one or more products in your order, Belle Miss undertakes to notify the customer by email as soon as possible, to offer other products in exchange, and if necessary, to refund the customer.
In the event of product unavailability, the customer has the choice of being informed by email if stock arrives. However, it is not possible to reserve an item.

XI - WARRANTY

XI.1 - Scope

Products are guaranteed against any material or manufacturing defect for a period of 1 year from the date of opening of the product and at the latest one (1) year from delivery.

In contracts concluded with non-professionals or consumers, the legal guarantee against hidden defects of the sold item applies in any event.

Under this warranty, the seller's sole obligation will be the free replacement of the identical product or by any other equivalent product.

To benefit from the warranty, any product must first be submitted to the Seller's after-sales service, whose agreement is essential for any replacement.

Any shipping costs are borne by the Seller.

Defective items must be returned to us by tracked letter (an additional €3 will be reimbursed to cover your shipping costs) or we can send you a Mondial Relay return label.

We will process the refund or exchange within 7 days of receiving the product.

XI.2 - Exclusions

The warranty does not cover apparent defects.

Also excluded are defects and deteriorations caused by external accident, or by a modification of the product not foreseen or specified by the seller.

 

XII - MISCELLANEOUS PROVISIONS

XII.1 - Partial invalidity

If one or more stipulations of these General Terms and Conditions of Sale are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other stipulations shall retain their full force and scope.

XII.2 - Entire agreement

These General Terms and Conditions of Sale and the order summary sent to the Buyer form a contractual whole and constitute the entirety of the contractual relations between the Parties.

In case of contradiction between these documents, the General Terms and Conditions of Sale shall prevail.

XII.3 - Governing Law - Disputes

By express agreement between the parties, this contract is governed by and subject to French law.

In the event of a dispute or claim, the buyer shall first contact the Seller to seek an amicable solution.

All disputes that may arise from this contract, concerning its validity, interpretation, execution, termination, their consequences and their follow-up, shall be submitted to the competent courts under ordinary law.
